1. Acceptance
By opting in to or using Gist, the authorized user agrees to these Terms and the accompanying Privacy Policy. If the user does not agree, the user should not use the service and may text STOP to unsubscribe.
2. Service description
Gist allows an authorized user to ask questions about CRM records, log interactions, update contact information, manage next steps and due dates, interpret screenshots, and receive task summaries. Features may change, be limited, or be unavailable from time to time.
3. Eligibility and authorization
Gist is intended only for an approved user with permission to access the connected CRM. The user must not share access, impersonate another person, or submit information the user is not authorized to process.
4. SMS and MMS consent
By texting START and completing any requested confirmation, the user consents to receive automated SMS and MMS messages from Gist at the enrolled mobile number. Messages include responses to user requests and, when qualifying tasks exist, up to one weekday morning task summary. Message frequency varies. Message and data rates may apply. Consent is not a condition of purchasing goods or services.
5. Opt-out and help
Reply STOP at any time to unsubscribe. After opting out, the user may reply START to resume. Reply HELP for assistance. Carrier message and data rates may apply.
6. User instructions and confirmations
Gist may ask follow-up questions when required information is missing, when a contact match is uncertain, or when an instruction could materially change a CRM record. The user is responsible for reviewing confirmations, spelling, dates, and proposed changes before approving sensitive or destructive actions.
7. AI-assisted processing
Gist may use automated and AI-assisted processing to interpret natural-language instructions, screenshots, names, dates, and CRM context. Automated output can be incomplete or incorrect. The user remains responsible for reviewing important records, decisions, commitments, and deadlines.
8. Acceptable use
The user must not use Gist to:
- Send unlawful, abusive, deceptive, harassing, or unauthorized content
- Access or alter records without permission
- Upload malware, harmful code, or content that infringes another person's rights
- Use the service for emergency communications or time-critical safety instructions
- Attempt to bypass authentication, security controls, or usage restrictions
9. Confidential and third-party information
The user is responsible for determining whether submitted business, client, prospect, or third-party information may lawfully and appropriately be processed through the service. The user should not submit information that is prohibited by contract, law, regulation, or professional obligation.
10. No emergency or professional service
Gist is a business productivity tool. It is not an emergency service and does not provide legal, medical, financial, accounting, or other licensed professional advice. Do not rely on Gist for urgent or safety-critical communications.
11. Availability and message delivery
Service availability, message timing, and delivery are not guaranteed. Wireless carriers, messaging providers, internet providers, and other third-party systems may delay, filter, duplicate, or fail to deliver messages. Carriers are not liable for delayed or undelivered messages.
12. Privacy
Information is handled according to the Privacy Policy. Mobile information, including mobile numbers and SMS consent, is not sold or shared with third parties or affiliates for marketing or promotional purposes.
13. Suspension and termination
Access may be suspended or terminated to protect the service, the CRM, the authorized user, or third parties; to investigate misuse; or to comply with legal requirements. The user may stop messaging at any time by replying STOP.
14. Disclaimer
Gist is provided on an “as is” and “as available” basis to the maximum extent permitted by law. No warranty is made that the service will be uninterrupted, error-free, accurate, secure, or suitable for every purpose.
15. Limitation of liability
To the maximum extent permitted by law, the operator of Gist and its service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost data, lost profits, missed opportunities, or business interruption arising from use of or inability to use the service.
16. Changes to these Terms
These Terms may be updated as Gist changes. Continued use after an update constitutes acceptance of the revised Terms. The effective date above will identify the current version.
